• Exemption of Clinical Trials Services from purview of Service Tax   Central Laboratories provide Central Laboratory Services which form an integral part of a Clinical Trial. The Central Laboratory Services involve the logistic movement (transport) of the patients/subjects biological samples from the investigator (Doctor) sites which participate in a Clinical Trial to the Central Laboratory for pathological analysis. The pathology laboratory report of such samples which are analyzed are sent to the investigator sites assist the investigators in assessing the well being of the patient/subject who participate in the clinical trial. At the end of the clinical trial the laboratory results play an integral part of the statistical analysis to determine the various effects of the study drug involved in the clinical trial. As Clinical Trials are exempted from Service Tax, Central Laboratory Services & Central Laboratories should also be exempted from Service Tax they are an integral part of the Clinical Trial.

 

• There should be tax incentives for labs accredited by NABL of Government of India. As of now accreditation is a huge cost but no benefits are provided for providing high quality services.

 

• All diagnostic kit should attract common VAT across the country. One rate of VAT all over India.

 

• Exemption or abolition of Waybills, Road Permits & Octroi for lab consumables like diagnostic kits and reagents. This will enhance free movement of goods from one place to another without any hindrance or loss of time.

 

• Zero Custom Duty shall be extended to all Diagnostics Kits (currently not applicable to all kits)

 

• e-governance for License / form 11: online application for various process like form 11 to Import kits – should be introduced
